Privacy Policy

Vortex Martial Arts (“Vortex Martial Arts,” “we,” “us,” or “our”) is committed to transparent data practices. This Privacy Policy explains what we collect, how we use it, and the choices you have. It also describes our consent, disclosure, quiet‑hours, do‑not‑call, and opt‑out practices for marketing communications, including those delivered using automated or AI‑assisted technology.

1) Information We Collect

• Identifiers and contact details (name, email, phone number, mailing address).

• Enrollment/consent records (channels opted into; whether consent qualifies as prior express written consent; timestamps; method; exact disclosure text; lead source; IP; user agent).

• Communications records (message content/templates, opt‑out requests and timestamps, call/chat recordings or transcripts where permitted by law).

• Program/transaction details (programs of interest, appointments, purchases, payment confirmations).

• Device/usage data (IP address, cookie IDs, referrer, pages viewed).

We do not knowingly collect personal information from children under 13. Parents/guardians may request deletion of a child’s data.

2) How We Use Information

• To provide programs and customer support, schedule classes, and respond to inquiries.

• To send communications you request or consent to receive (text, email, call, chat).

• To comply with federal and Texas laws, including consent/opt‑out, disclosure, quiet‑hours, and Do‑Not‑Call obligations.

• To maintain proof of consent and opt‑out actions, prevent fraud, and improve our services and website.

3) Consent Standards for Marketing Communications

For marketing texts, for calls using prerecorded/artificial or AI voice, and for automated or AI‑assisted communications, we obtain prior express written consent (PEWC) from you. Consent is specific to each channel (e.g., SMS, voice, email, chat) and is never a condition of purchase or service. Consent is captured via unchecked checkboxes or other clear, affirmative actions accompanied by disclosure text that: (a) identifies Vortex Martial Arts as the sender; (b) explains that messages may use automated or AI technology and/or an automatic telephone dialing system or prerecorded/artificial voice; (c) states that consent is not a condition of purchase; (d) explains message frequency and that message/data rates may apply; and (e) explains how to opt out.

Service or transactional messages are sent as needed to provide the services you request (e.g., receipts, schedule changes). We still honor your communication preferences for those messages to the extent the law allows.

4) Required Disclosures in Communications

Where required by law (including Texas telemarketing rules), our marketing communications identify Vortex Martial Arts and the purpose of the message at the outset. For outbound calls that use automated, AI, prerecorded, or artificial voice, we disclose this at the beginning of the call and provide an immediate opt‑out method.

5) Opt‑Out & Do‑Not‑Call Compliance

• SMS/Chat: Reply STOP to unsubscribe; HELP for help. We include an opt‑out method in every marketing text/chat and honor requests immediately.

• Email: Click the unsubscribe link in any marketing email to stop future marketing emails.

• Calls: Ask to be placed on our internal do‑not‑call list; we will honor your request promptly.

• Do‑Not‑Call Lists: We honor the Texas No‑Call List and the National Do‑Not‑Call Registry by suppressing solicitations to registered numbers unless we have valid prior express consent (e.g., PEWC) or another lawful exception applies.

• Quiet Hours (Texas): For Texas residents, we do not send marketing communications outside 9:00 a.m.–9:00 p.m. Monday–Saturday and 12:00 p.m.–9:00 p.m. Sunday (Central Time).

6) Registrations and Bonding

Where required, Vortex Martial Arts maintains registrations and surety bonds under Texas Business & Commerce Code Chapter 302 for solicitation activities involving Texas residents.

7) Children & Teens

We do not knowingly market to children under 13. For teens ages 13–17, we do not enroll them in marketing programs without appropriate parental or guardian permission where required by law.

8) Sharing of Information

We do not sell personal information. We share information only with service providers that help us operate (e.g., messaging platforms, CRM, scheduling), with legal authorities if required, or with a successor in a merger/acquisition. Service providers are bound to use information only to perform services for us.

9) Data Retention

We retain consent and opt‑out logs and related records for at least four (4) years (or longer if required by law). Other records are kept only as long as necessary for the purposes in this Policy or as required by law.

10) Security

We use reasonable administrative, technical, and physical safeguards to protect personal information. No method is 100% secure, but we regularly evaluate and improve our measures.

11) Your Rights (Texas & U.S.)

Texas residents may have rights under the TDPSA, including the right to know, access, correct, delete, and obtain a portable copy of personal data and to opt out of targeted advertising and certain profiling. You may submit a request at [privacy email / webform / phone]. We will verify and respond as required by law.

12) Changes to this Policy

We may update this Policy from time to time. When we make material changes, we will post the updated version with a new Effective Date and, where appropriate, provide additional notice.
